Indenture between Thomas & David Slade and James
Johnston Grieve, Charles Phillip Hunter & Robert Grieve
This INDENTURE made the twenty seventh day of March one
thousand eight hundred and seventy one BETWEEN Thomas Slade and David
Slade of Poole in the County of Dorset Merchants of the one part and
James Johnston Grieve at present staying in London Member of
Parliament for the Burgh of Greenock in the Kingdom of Scotland
Charles Phillip Hunter of Greenock aforesaid Merchant and Robert
Grieve of the Island of Newfoundland in North America Merchant
(hereinafter called the purchasers) all copartners in trade carrying
on business in Greenock aforesaid under the style of firm of “Baine &
Johnstone” and in Newfoundland under the style or firm of Baine
Johnston and Company of the other part WHEREAS by an Indenture dated
the 19th day of January one thousand eight hundred and
forty eight and made between Robert Slade of Poole aforesaid Esquire
of the one part and the said Thomas Slade and David Slade of the other
part the hereditaments and premises hereinafter described and intended
to be hereby assured were with other premises released and conveyed
unto and to the use of the said Thomas Slade and David Slade their
heirs executors administrators and assigns AND WHEREAS the said
purchasers have agreed with the said Thomas Slade and David Slade for
the absolute purchase of the said hereditaments and the inheritance
thereof in fee simple in possession free from incumbrances for the sum
of eight hundred pounds NOW THIS INDENTURE WITNESSETH that in
pursuance of the said agreement and in consideration of eight hundred
pounds upon the execution of these presents paid by the said
purchasers to the said Thomas Slade and David Slade (the receipt of
which said sum of eight hundred pounds the said Thomas Slade and David
Slade do and each of them doth by these presents grant and confirm
unto the said purchasers their heirs and assigns ALL THOSE fishing
messuages or dwelling houses plantations storehouses stakes stages
wharfs buildings beaches lands and premises situate lying and being at
or near a certain Harbour on the coast of Labrador in North America
called Battle Harbour formerly in the tenor or occupation of John
Slade Esquire deceased since of David Slade deceased and James Slade
deceased and late of the said James Slade alone and now or late of the
said Thomas Slade and David Slade and also all ways runs waters
watercourses fishing woods right of pasturage and all other rights and
privileges easements profits commodities advantages emoluments
hereditaments and appurtenances whatsoever to the said fishing rooms
or plantations aforesaid belonging or in anywise appertaining or to or
with the same or any part thereof now or at an time here to for
usually had held used occupied possessed or enjoyed or accepted
reputed deemed taken or known as part parcel or member thereof or any
part whereof or appurtenant thereto And the reversion and reversions
remainder and remainders yearly and other rents issues and profits
thereof and of every part and parcel thereof and of every part and
parcel thereof and all the estate right title interest use trust
possession property possibility claim and demand whatsoever both at
law and in equity of them the said Thomas Slade and David Slade or
either of them of in to or out of the said premises every or any part
thereof TO HAVE AND TO HOLD the said fishing rooms or plantations
messuages hereditaments and all and singular other the premises
hereinbefore expressed to be hereby granted unto the said James
Johnston Grieve Charles Phillip Hunter and Robert Grieve their heirs
executors administrators and assigns as such copartners in trade as
aforesaid To the Use of the said James Johnston Grieve Charles
Phillips Hunter and Robert Grieve their heirs executors administrators
and assigns forever. Covenant for good title unencumberance peaceable
possession and for further assurance IN WITNESS WHEREOF the said
parties to these presents have hereunto set their hands and seals the
day and year first above written Thos. Slade(LS) David Slade(LS)
Signed sealed and delivered by the within named Thomas Slade and David
Slade in presence of H. W. Dickinson, Solr. Poole Dorset. Geo. Farwell
his clerk. Received on the day and year first within written of and
from the within written named James Johnston Grieve Charles Phillip
Hunter and Robert Grieve the sum of eight hundred pounds being the
full consideration money within expressed to be paid by them to us.
Thos. Slade and David Slade, H.W. Dickinson, Geo. Farewell. On the 17th
day of May 1871 came and appeared before me Thomas Slade and David
Slade both within named and did severally acknowledge the within to be
their several act and deed and that the names Thos. Slade and David
Slade there to appended were their respective signatures. Witness my
